Information you should know about Traffic Diversion.

The County Attorney, Jan Satterfield, of the 13th Judicial District of Kansas has established a Diversion Program for some traffic offenses. 

You are eligible to apply if you are a first time offender with the exception of traffic citations.  You cannot have received more than 1 violation in the last 6 months and no more than 3 violations in the last 3 years.

Diversion is a privilege and not a right; the County Attorney may deny the application for diversion if the defendant was belligerent, obnoxious, or un-cooperative with the law enforcement officers involved, and if the drug and alcohol evaluator recommends against diversion and if diversion is not in the best interest of the community.  If accepted, the defendant will enter into an agreement for pretrial diversion.  The proceedings shall be continued for 3 to 12 months at defendant’s request.  Upon successful completion of diversion, the charges will be dismissed.  Failure to successfully complete diversion will result in the case being set for trial.

If you want to apply for diversion on Driving While Under the Influence or Possession of Marijuana, you must first obtain an alcohol and drug evaluation and submit it along with your diversion application. 

If you want to apply for diversion, taking into consideration all of the preceding information, you must fill out the application completely and send to: Butler County Attorney Office, 201 West Pine, Suite 104, El Dorado, and Kansas 67042.  

Make sure your offense is not an ineligible offense listed above.  If you are ineligible to apply, but do so, your application will be denied.
