Commission Chairman Will Carpenter called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Phil Anderson, Commissioner Randy Doll, Commissioner Bill Shriver, Commissioner Mike Wheeler, Assistant County Administrator, Mark Detter, and Clerk Ron Roberts. County Administrator, Will Johnson, Jr., was absent.
ITEM #1 – RECEIVE
CHUCK FINCHAM TO DISCUSS THE POSSIBILITY OF REDUCE TIPPING FEES FOR CLEAN-UP OF
EAST GARDEN MOBILE PARK
Chuck Fincham came
before the Board to discuss the possibility of reduced tipping fees for clean
up of East Garden Mobile Park.
The Commissioners
wanted more information about the volume of trash, the type of trash, and how
the trash would be delivered, crushed and compacted or would whole trailer
houses be brought in. The Commissioners requested Mr. Fincham return at a
future date with the additional information.
ITEM #2 – CONSIDER A
REQUEST FOR REZONE FROM AG-40 TO RR AND A LOT SPLIT. CASE NO. RZ-04-12 AND
PL-04-13. RESOLUTION 04-49.
David Yearout,
Interim Director of Planning & Development, came before the Board for
approval of a request from Chuck & Michelle Counterman to rezone property
located on the SW corner of NW Shumway and NW 30th in Section 13,
Township 25S, Range 4E from AG-40 to RR and also approval for a lot split. This rezone is for the purpose of creating
three Rural Residential tracts of land.
The property owners want to sell the house and five acres and split the
remaining land into two tracts for their two daughters.
Commissioner Doll
motioned to approve Zoning Case RZ-04-12, Case PL-04-13, and Resolution No.
04-49 with the following conditions:
Prior to issuance of a building permit, record the Counterman’s Corner
Final Plat in the Butler County Register of Deeds. Commissioner Wheeler seconded the motion. Commissioner Shriver motioned to the amend
the motion to include all conditions and findings contained in section 21-108
of the zoning case. Commissioner Doll
seconded motion. Motion on amendment
carried 5-0. Original motion as amended
carried 5-0.
ITEM #3 – CONSIDER A
REQUEST FOR HOMESTEAD LOT SPLIT WITH AGRICULTURE PRESERVATION OVERLAY. CASE NO. PL-04-12.
David Yearout,
Interim Director of Planning & Development, came before the Board for
approval of a request from the Foulston Family Trust – Christy & David
Reynolds for a Homestead Lot Split with Agriculture Preservation Overlay (APO)
(Case No. PL-04-12). The property is
located on SW Indianola Road, South of Parallel, North of 15th of
Section 2, Township 26S, Range 3E. This
proposal is to split off the existing home and five acres and reserve the
remainder of the property in an APO.
Commissioner
Carpenter motioned to grant approval of the Foulston Family Trust request for a
Homestead Lot Split with an APO (Agriculture Preservation Overlay) Case #
PL-04-12. Commissioner Shriver seconded
the motion. Motion carried 5-0.
Commissioner Carpenter recessed the Board at 9:40 a.m. for 10 minutes.

ITEM #4 – RECEIVE
ENGINEERING PROPOSALS FOR BIENNIAL INSPECTION OF COUNTY BRIDGES
Darryl Lutz,
Director of Public Works, came before the Board to receive engineering proposals
for biennial bridge inspection work for Butler County. A minimum of every two years, each bridge
with a 20 foot span or longer is required to be inspected by certified bridge
inspection personnel. An inspection
report and narrative are updated and new bridge sufficiency ratings are
calculated for each bridge. Butler
County has approximately 436 bridges that require this inspection. Sealed proposals were to be submitted to the
Director of Public Works by Monday, October 25, 2004. Bids were received from:

Commissioner
Carpenter motioned to authorize the Director of Public Works to review
engineering proposals for conducting required biennial bridge inspection work
on Butler County’s bridges located on County and Township roads and to return
at a later date with a report and recommendation for award of work. Commissioner Shriver seconded the
motion. Motion carried 5-0.
ITEM #5 – CONSIDER
ADOPTING LANDFILL FEES TO BE EFFECTIVE JANUARY 1, 2005
Darryl Lutz, Director of Public Works, came before the Board to consider
adopting landfill fees for 2005 as approved in the 2005 adopted budget. The current tipping fees are $27 per ton for
regular trash and $18 per ton for C & D waste with a minimum vehicle charge
of $7. The minimum vehicle charge is
proposed to be maintained at $7 and the tipping fees be raised to $28 per ton
for regular trash and $19 per ton for C & D waste.
Commissioner Shriver motioned to approve the proposed landfill fees and
tipping fee policy dated October 26, 2004 to become effective January 1, 2005
to increase the landfill-tipping fee by $1 per ton for regular waste and for C
& D waste. Commissioner Wheeler
seconded the motion. Motion carried

ITEM #6 – CONSIDER
AUTHORIZING THE DEPARTMENT OF PUBLIC WORKS TO OBTAIN LETTERS OF INTEREST AND
STATEMENTS OF QUALIFICATIONS FOR CONSTRUCTION ENGINEERING WORK RELATED TO THE
SW 170TH STREET PROJECT AT ROSE HILL
Darryl Lutz, Director of Public Works, came before the Board for
authorization for the Department of Public Works to obtain letters of interest
and statements of qualifications for construction engineering work related to
the SW 170th Street project at Rose Hill. Reconstruction is scheduled in 2005 for SW 170th
Street between the Sedgwick County line and Rose Hill Rd. This is a major federal project requiring
construction engineering resources beyond Butler County’s staff resources. Federal aid funds will pay for 80% of the
cost of construction engineering. This
project is budgeted in the federal aid 5-year plan and budgeted in the 2003
Road Construction CIP and adopted 2005 Road & Bridge Fund budget.
Commissioner Anderson motioned to authorize the Director of Public Works
to solicit Letters of Interest and Statements of Qualifications for
construction engineering services related to Project No. 8 C-3857-01, the
reconstruction of SW 170th Street at Rose Hill. Commissioner Doll seconded the motion. Motion carried 5-0.
OTHER ITEMS OF BUSINESS TO COME
BEFORE THE BOARD
Commissioner Anderson suggested that we develop detailed procedures for anyone considering various zoning actions. These procedures will take the applicant through the process step by step as well as provide pertinent information as to the feasibility of the requested change. The suggestion received very positive support from the rest of the commissioners. It was the consensus of the board to have Commissioner Anderson spearhead and oversee the project.
Commissioner Shriver requested a short recap of the Wholesale Water District meeting last night at Andover.
Larry Powell, Butler County Economic Development Director, came before the Board to report on the status of the rail line salvage from Andover to Augusta. L.B. Foster will bring its salvage contractor in next week and will review the removal process with the County prior to starting the project.
Mr. Powell also reported that he met with the Greenwood County Commissioners and interested landowners concerning the issuance of an NITU certificate to Butler County on the section of the Kansas Eastern rail line from Leon to Severy. Mr. Powell felt the meeting went well and they were receptive to reviewing with the Rail Road what actions they could take separately or with Butler County to take control of the portion of the rail right of way in Greenwood County.

Commissioner Wheeler motioned to adjourn the meeting of the Board on October 26, 2004 at 10:40 a.m. Commissioner Shriver seconded the motion. Motion carried 5-0.
1. Secured
Loads - All loads of waste entering the landfill shall be secured with an
adequate cover or bindings that prevent waste from falling/blowing off of the
vehicle while in transit. A charge of
double the standard tipping fee for the type of material will be assessed on
all unsecured loads of waste entering the landfill.
2. Minimum
Load Charge - A minimum load charge will be assessed for automobile and light
pickup loads of waste.
3. Fee by
Count - A per count charge will be assessed on tires. Whole tires and white
goods are prohibited from being disposed of in the landfill. These items are to be placed in designated
bins as directed by the landfill attendant.
Additional charges will be assessed for tires with rims and for
appliances with refrigeration units.
4. Fee by
Weight - All load sizes or waste types not covered under the Minimum Load
Charge or under the Fee by Count or for any loads hauled by a contract hauler
shall be charged on the basis of weight rounded to the nearest 20 pounds.
5. Special
Waste - All waste requiring special handling or KDHE authorization shall be
assessed a double charge for disposal costs plus a handling fee.
6. Unlisted
Waste Types - Butler County reserves the right to restrict and/or prohibit the
disposal of any wastes in the Butler County Landfill. Any wastes permitted to be disposed of in the landfill and not
shown on the price schedule will be assessed a charge as determined by the
Manager of the Butler County Landfill.
7. All cash
transactions will be rounded to the nearest $0.25.
8. Out-of-County
Waste – Waste which is generated outside the boundaries of Butler County will
not be accepted at the Butler County Landfill.
9. Vehicles must be unloaded and weighed out before 5:30 p.m.
