BUTLER COUNTY BOARD OF COMMISSIONERS

Tuesday, June 10, 2003 & Wednesday, June 11, 2003

Commission Chairman Will Carpenter called the Butler County Board of Commissioners to order at 6:30 PM at Butler County Community College. (Joint meeting with Butler County Community College) Present were Commissioner Phil Anderson, Commissioner Randy Doll, Commissioner Bill Shriver, Commissioner Mike Wheeler, Administrator Will Johnson Jr., and Clerk Brenda Brychta.

ADDS & ABATES

Commissioner Shriver motioned to approve the Adds & Abates #2150. Adds are $00.00 and Abates are $11,964.38. Commissioner Doll seconded the motion. Motion carried 5-0.

ITEMS OF BUSINESS:

ITEMS #1 – WORK SESSION – SALES TAX FORCE COMMITTEE MEMBERS

Commissioner Doll presented the following list for Sales Tax Force Committee members from District #1:

Administrator Johnson stated that he would send a packet to the members, listed above, thanking them for volunteering for this committee. The packet will also contain guidelines for the committee to follow. Probable start time will be late summer or early fall.

There were no other items of business.

RECESS

Commissioner Shriver motioned to recess the Board from 7:00 PM to 7:15 PM at which time the Board will reconvene and join the Butler County Community College Board for a joint meeting. Commissioner Anderson seconded the motion. Motion carried 5-0.

RECONVENE

Commissioner Carpenter reconvened the meeting of the Board at 7:15 PM.

ITEMS OF BUSINESS

The County Commissioners and Butler County Board of Trustees met in joint session for dinner and discussion. Commissioner Wheeler excused himself from the meeting at 8:00 PM. Trustees and Commissioners then discussed issues affecting each of the organizations.

RECESS

Commissioner Anderson motioned to recess the Board at 9:03 PM until June 11, 2003 at 6:30 PM, for a work session with the City of Andover, at Mascio’s Restaurant in Augusta, Ks. Commissioner Shriver seconded the motion. Motion carried 4-0.

RECONVENE

Commissioner Carpenter reconvened the meeting of the Board at 6:30 PM on June 11, 2003. Present were Commissioner Randy Doll, Commissioner Bill Shriver, Commissioner Mike Wheeler, Administrator Will Johnson, Jr., County Clerk Ron Roberts, City of Andover Mayor, Ben Lawrence, Andover Council members Sheri Geisler, Caroline Hale, Charley Lewis, Bob Ruth and Keith Zinn. Commissioner Phil Anderson and Councilman, John McEachren were absent from this session.

ITEM #1 – WORK SESSION

Mayor Lawrence opened the discussion expressing his appreciation of the county meeting with them and opening the door to a new and improved relationship between the city and county.

The discussion then moved to the county disposition of the Bridalwood Addition property lease which the county is working on with Dan Taylor. The first concern was the term of the lease, the stated term of 99 years for a dollar seemed too long to several of Andover’s council members. They asked the county to consider something more in the 12 to 15 year range to allow future city and county governing bodies to reevaluate its potential for public use.

Commissioner Doll responded that he thought that FEMA required them to use a 99-year term.

The next point concerned the responsibility for up keep of the roads in the addition and also police protection responsibility. The county informed them that the roads were now township roads and the responsibility for their maintenance would continue to be with the township, In the matter of police protection that responsibility should stay primarily with the County Sheriff, however because of the phone numbers there, any 911 calls would route to Andover and they would have to forward them too the county just as they currently do.

The next point was since the lease would put the property back on the tax rolls would the tax payers in the county be responsible for paying the taxes? Commissioner Doll stated that those taxes would be passed on to Mr. Taylor through the lease agreement, but due to its Agricultural Zoning, the taxes would be minimal.

Andover asked about how any future need for utility or road easements would be handled. Commissioner Doll stated that ownership would remain with the County and they would have the power to grant any required easements or rights of way in the future.

The protective covenants attached to the property to restrict certain uses came up for discussion. There was concern from Andover that Butler County Ag zoning allowed uses not compatible with existing adjacent residential uses, such as cattle, hog farming or a motocross track. After some discussion Commissioner Carpenter suggested that Andover submit a list of suggested restrictions, to the County, for their consideration.

Mayor Lawrence stated that he thought the meeting was a step forward for city and county officials.

Commissioner Shriver motioned to adjourn the meeting of the Board at 9:05 PM. Commissioner Doll seconded the motion. Motion carried 4-0.
