BUTLER COUNTY BOARD OF COMMISSIONERS

Tuesday, April 29, 2003

Commission Chairman Will Carpenter called the Butler County Board of Commissioners to order at 9:00 AM. Present were Commissioner Phil Anderson, Commissioner Randy Doll, Commissioner Bill Shriver, Commissioner Mike Wheeler, Administrator Will Johnson Jr., and Clerk Brenda Brychta.

ITEMS OF BUSINESS:

RECEIVE CRAIG MURPHY OF THE BUTLER COUNTY SHERIFF’S OFFICE

Captain Craig Murphy, of the Sheriff’s office informed the Board that the US Marshall’s office called and stated that they would be sending inmates to the County Jail within the next two weeks.

Craig Murphy informed the Board that an officer in the Douglass area has resigned and requests hiring for this position. It was the consensus of the Board to fill the vacancy.

RECEIVE JIM RALSTON OF APAC KANSAS, INC.

Jim Ralston, of APAC Kansas, Inc., came before the Board to present an idea of a way to move dirt from one development in Andover to another. His plan would place railroad ties parallel to the existing rails and adding four (4) foot of dirt on top of the rails. Then after the developments are complete the dirt would be removed and the rails restored to original status. This would prevent the trucks, hauling the dirt, from using the township road possibly tearing it up. The City of Andover would need to write a change order to his contract and damages would be covered under the current performance bond with Andover.

County Engineer, Darryl Lutz, will work with Mr. Ralston and Poe & Associates, the City of Andover engineer on the project.

ITEM #1 – CONSIDER APPROVING THE FY04 ADULT COMMUNITY CORRECTIONS COMPREHENSIVE PLAN FOR SUBMISSION TO KANSAS DEPARTMENT OF CORRECTIONS.

Chuck McGuire, Director of Community Corrections of 13th Judicial District, came before the Board for consideration of the FY04 Adult Community Corrections Comprehensive Plan for submission to Kansas Department of Corrections. This is an annual process in order to procure funding from the KDOC for the supervision of adult offenders in the 13th Judicial District.

Commissioner Carpenter motioned to approve the FY04 Adult Community Corrections Comprehensive Plan for submission to the Kansas Department of Corrections. Commissioner Doll seconded the motion. Motion carried 5-0.

ITEM #2 – CONSIDER APPROVING THE AMENDED FLEXIBLE BENEFIT PLAN.

Administrator Johnson came before the Board to review and seek approval of the amended Flexible Benefit Plan for employees. This plan increases the maximum reimbursement and contribution amount of employees from $2,000 to $2,500. These are pre-tax dollars.

Commissioner Doll motioned to approve the amended Flexible Benefit Plan. Commissioner Anderson seconded the motion. Motion carried 5-0.

OTHER ITEMS OF BUSINESS

County Engineer, Darryl Lutz, came before the Board to remind Commissioners Carpenter, Doll and Wheeler that they will be performing a Road View on Monday, May 5, 2003 at 8 AM

Commissioner Doll asked for further discussion on a County Sales Tax. Mr. Johnson will do further research and place this item on the agenda for next week.

Commissioner Carpenter informed the Board that the National Conference of Youth Development will be on May 5, 2003 from 2-4 at the First Christian Church in Augusta.

Commissioner Shriver motioned to adjourn the Board at 10:10 AM. Commissioner Wheeler seconded the motion. Motion carried 5-0.
