BUTLER COUNTY BOARD OF COMMISSIONERS

Monday, September 23, 2002

Commission Chairman Randy Doll called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Bill Shriver; County Administrator, Will Johnson Jr., and Deputy Clerk Barbara Day. Commissioner Carpenter was absent.

 

APPROVAL OF MINUTES

Commissioner Doll made a motion to approve the minutes for September 16th, and 17th, 2002.  Commissioner Shriver seconded the motion. Motion carried 2-0.

 

APPROVAL OF VOUCHERS

Commissioner Shriver made a motion to approve the vouchers in the amount of $1,096,670.23 of which $702,230.57 is for Public Building Commission. Commissioner Doll seconded the motion. Motion carried 2-0.

 

GRANT AWARD FOR BUTLER COUNTY DEPARTMENT ON AGING

Connie Rausch, Department on Aging presented for approval four federal grants through Central Plains Area Agency on Aging; all four grants are renewals.

 

Ms. Rausch advised the Board of Commissioners that the Butler County Department on Aging has been awarded four federal grants through the CPAAA; all four grants are renewals; three have the required match budgeted for 2003; the fourth grant (Caregiver I&A) does not require a match. The grant period is from 10-1-02 through 9-30-03.

Commissioner Doll made a motion to approve Grant #1 for the amount $6,500 for Disease Prevention, and allow the Chairman to sign. Commissioner Shriver seconded the motion. Motion carried 2-0.

 

Commissioner Doll made a motion to approve Grant #2 for Supportive Services for the Senior Center’s in the amount of $9,315, and allow the Chairman to sign. Commissioner Shriver seconded the motion. Motion carried 2-0.

 

Commissioner Doll made a motion to approve Grant #3 for Information Assistance to the Senior Center’s in the amount of $21,250, and allow the Chairman to sign. Commissioner Shriver seconded the motion. Motion carried 2-0.

 

Commissioner Doll made a motion to approve Grant #4 for Caregiver’s Service in the amount of $11,340, and allow the Chairman to sign. Commissioner Shriver seconded the motion. Motion carried 2-0.

 

 

 

OTHER

Lyle Gray of 13789 SE 60th Leon, Ks., Dean Bender 12705 SE Hwy 54 Rosalie, Ks., and                       

Marty Brendan came before the Board of Commissioners to express their support for wind farms in the Flinthills area. Mr. Gray stated that the energy generated from the wind farms is a necessary factor for the Flinthills area. Mr. Gray also stated that the revenue that would be generated for the school district would be an asset for the area. All three residents wanted to express their support in favor of the wind farms for the Flinthills area.

 

COMPLAINT ON CHEMICAL USE

Riley Walters, Director of Noxious Weed Department, came before the Board of Commissioners to discuss a written complaint on application of pesticide.

 

Mr. Walters presented a complaint, Incident No. 1SH069/Case No. 02 PEST 2320, which states that on July 12, 2001 Shawn Hacked, authorized representative of the Secretary of Agriculture initiated an investigation in which he obtained a written statement from Pat Angels regarding damage to a field of cotton located in the E ½ of the NE ¼ of Sec. 8, Two. 29S, Re. 3E, Butler County, Kansas.

 

Mr. Hackett states that he walked the cotton field in question and observed damage to the cotton crop. On July 13, 2001 Mr. Hackett met with Riley Walters, Director of the Butler County Noxious Weed Department. Mr. Walters is a certified applicator (number 979) and has a current registration. Butler County holds a valid governmental agency registration (number 120) for the year 2001 and a current registration. Mr. Hackett issued a notice of inspection and Mr. Walters showed Mr. Hackett the pesticides, which were used when he sprayed the pasture of Marvin Small on June 15, 2001, at approximately 11:00 a.m. Mr. Walter used a tank mix containing Cornbelt 4lb. Amine (EPA Reg. No. 1773-2) a Dow AgroSciences Tordon 22K (EPA Registration No. 62719-6). Mr. Walters advised a boom sprayer was used to spray the 6.4 acres with the lots, and the lagoon was sprayed with a hand sprayer, with the target being bindweed.

 

Mr. Hackett’s findings to the Butler County Noxious Weed Department addressed to Randy Doll, Chairperson of the Butler County Commissioners of Butler County, Kansas and Director Riley G Walters were found to have violated K.S.A. 2-2453(a) on June 15, 2001.

 

The Board of Commissioners took no further action at this time, until the complaint could be reviewed with County Counsel Norm Manley.

 

WHOLESALE WATER WORKSHOP UPDATE

Administrator Johnson advised the Board of Commissioners of a letter that outlines the proposed summary of issues for a planning session, had been sent out to the five City Administrators; Stan Stewart, City of El Dorado, Jeff Bridges, City of Andover, Mark Detter, City of Rose Hill, Bill Kiefer, City of Augusta, and Jo Miller, City of Towanda. Mr. Johnson stated that he has been working with the City Administrator’s on this issue. Mr. Johnson stated that when he received the comments he would submit the information received to all the Cities for scheduling of the planning session for the wholesale water district.

 

FIRE DISTRICT #1

Administrator Johnson advised the Board of Commissioners that the final meeting for Fire District #1 will be held tonight September 23, 2003, and that City Administrator Jeff Bridges would be presenting the final contract and discuss employee benefits. Mr. Johnson advised the Commissioners that they would probably be receiving the contract for review by September 30th.

 

UNIFORM BID REVIEW FOR THE JAIL

Sheriff Stan Stewart and Jail Administrator Ben Crooks came before the Board of Commissioners with a sealed bid for uniforms for the new Jail Facility.

 

Mr. Crooks advised that he sent out three bid requests for uniforms and received only one sealed bid back.

The only sealed bid received was from Cintas Corporation 9333 E 35th Street North, Wichita, Ks.

Commissioner Doll made a motion to receive the bid from Cintas Corporation for uniforms for the Jail Facility and have Administrator Crooks return to the Board of Commissioners with his recommendation. Commissioner Shriver seconded the motion. Motion carried 3-0.

 

PUBLIC BUILDING COMMISSION

Administrator Johnson advised that Jay Newton, Director of Public Building Commission, went into the hospital today for back surgery and would be taking rehabilitation treatments for approximately 6 months. Mr. Johnson advised that when speaking with Mr. Newton he stated that he would be available for support calls. The 

Board of Commissioners directed Mr. Johnson to take the lead on the PBC supervision

in Mr. Newton’s absence.

Commissioner Doll made a motion to dismiss at 11:35 a.m. Commissioner Shriver seconded the motion. Motion carried 2-0.
