BUTLER COUNTY BOARD OF COMMISSIONERS

Monday, February 25, 2002

 

Commission Chairman Randy Doll called the Butler County Board of Commissioners to order. Present were Commissioners Bill Shriver and Commissioner Will Carpenter; Jay Newton, County Administrator and Linda Peterson, Commission Secretary.

 

APPROVAL OF MINUTES

Commissioner Shriver moved to approve the Butler County Commission meeting minutes of Tuesday, February 19, 2002, Wednesday, February 20 and Thursday, February 21, as amended.  No meeting was held on Monday, February 18, 2002, due to the Courthouse being closed for Presidents Day.  Commissioner Doll seconded the motion. Motion carried 3-0.

 

VOUCHERS

Commissioner Doll moved to approve the vouchers in the amount of $ 981,092.16

dated February 26, 2002.  Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

ADDS/ABATES

Commissioner Carpenter moved to approve the Adds in the amount of $+68,322.38 and the Abates in the amount of -$3,426.62, with the approval #2091 dated February 25th.     Commissioner Shriver seconded the motion.  Motion carried 3-0.

 

COUNTY COMMISSION DISTRICT BOUNDARIES

Mr. Jay Newton, Administrator, and Ronald Roberts, County Clerk presented to the Board for discussion, a resolution to establish County Commission District boundaries as required by K.S.A. 19-204.  Mr. Roberts informed the Board that District 1 & 3 needed some changes to come in line with District 2, which is fine.  He also stated that they could leave it as is and still be fine.  Mr. Roberts also informed the Board that the Commission is supposed to be looked at this at least every 3 years, to determine if they are as equal in population as possible.

 

Commissioner Doll moved to review this proposal and talk about this at next weeks meeting.  Commissioner Carpenter seconded the motion.  Motion carried 3-0

 

 

 

TOWNSHIP RESIGNATION/APPOINTMENT POLICY

Mr. Jay Newton, Administrator presented to the Board for discussion a proposed Township Resignation/Appointment Policy.   The policy reads as follows:

 

Resignation as a Board Member is not effective until a letter stating such has been received in the County Clerk’s Office.

 

Following receipt of a resignation letter, the County Clerk shall notify the County Commission of such resignation.  Thereafter, the Clerk shall publish, or cause to publish, said vacancy, along with a solicitation for applications for replacement.

 

The appropriate District Commissioner will review the applicants, and may consult with the existing board for recommendations.  The District Commissioner shall then make a recommendation to the other Board of Commissioners for a vote on the appointment.

 

Commissioner Shriver moved to approve the Township Resignation/Appointment Policy and authorize the Chairman to sign.  Commissioner Carpenter seconded the motion.  Motion carried 3-0

 

Commissioner Shriver made a motion to have a resolution drawn up for the above policy.  Commissioner Doll seconded the motion.  Motion carried 3-0

 

 

ECONOMIC DEVELOPMENT/PORT AUTHORITY

Larry Powell, Butler County Economic Development Director, came before the Board to update the Commissioners on the projects that are going on now.

 

Mr. Powell stated that the following items were for the Boards information only.  This included the pipeline license, which Norman Manley and the City of Augusta are reviewing.  This agreement will be brought back before the Commission at a later date for their review.

 

Mr. Powell also gave the Commission a copy of the Butler County Railroad Lease Agreement assumed December 2001.  Commissioner Doll requested that a method of payment and due date be added.

 

Mr. Powell gave the Commissioners a copy of the Interim Trail Use Agreement between Butler County and the Kansas Eastern Railroad.  Commissioner Shriver asked if Butler County could acquire the rest of the Railroad from Leon east to the County line.  Mr. Powell stated that this portion was not available at this time.  Commissioner Carpenter requested that there be a cover letter from the attorney which drew up this agreement or something showing his name and firm on the agreement.

 

Mr. Powell submitted an agreement made with Butler County and the Butler County Port Authority to the Commissioners.  Commissioner Shriver moved that the Board receive this agreement and come back at a later date to review.  Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

OTHER ITEMS

 

REQUEST FOR RECORD COPY

Ronald Roberts, County Clerk came before the Board with an example of the “Request For Records Form”  Mr. Roberts informed the Commission that there is a list of people that are sent Commission minutes on a regular basis, this form is sent out annually is to keep our records updated.  The form is used if somebody request information that is stored off site, or that there will be a charge for or will take staff time to prepare. This allows the requesting party to know in advance what the charges and time is going to be.

 

AMERICAN METROPOLITIAN ENVIRONMENTAL INC.

Commissioner Shriver moved to accept the proposal from American Metropolitan Environmental, Inc. for conducting an investigation for possible fungi and bacteria contaminated building materials in the Butler County Courthouse and Jail and authorize the Chairman to sign.  Commissioner Carpenter seconded the motion.

Motion carried 3-0

 

BARNHILL HOME

Mr. Jay Newton, County Administrator reported to the Board the he had visited with Mrs. Barnes, (Mrs. Barnhill’s Daughter) in reference to her mother moving out of the building on Pine Street where the construction of the Jail/Judicial Building is taking place.  Mrs. Barnhill told her daughter “The County said she could live in her apartment for as long as she was alive and that is what she is going to do” Commissioner Doll stated he felt that the County was in a very liable spot with her living there while the construction was going on.

 

REZONING

C. J. Livingston came before the Board representing the Planning and Zoning Board of the Butler County Board of Realtors and an Individual Rancher.   Mr. Livingston was concerned about when the moratorium was going to be lifted, because he can not sell part of his land until it is.  Commissioner Carpenter told him that they were to get the report from Todd Kennemer, Butler County Planning & Zoning Director next week.  There would be a decision made after that.

 

 

EXECUTIVE SESSION

Commissioner Doll moved to go into Executive Session at 10:35 a.m. and return at

11:35 a.m. to discuss Personnel matters of individual non-elected personnel.  Commissioner Carpenter seconded the motion.  Motion Carried 3-0.

 

RECONVENE

The Commission reconvened at 11:35 a.m.

Commissioner Doll moved to adjourn the meeting. Commissioner Carpenter seconded the motion.  Motion carried 3-0.
