BUTLER COUNTY BOARD OF COMMISSIONERS

The Butler County Board of Commissioners was called to order by Commission Chairman, Bill Shriver.  Present were Commissioners Randy Doll and Will Carpenter along with County Administrator, Jay Newton and Commission Secretary, Marcy Zwall. 

 

RESOLUTION 01-13

Todd Kennemer, Planning & Development Director, presented & reviewed a request for a Conditional Use Permit by Bob Bergkamp Construction Co., to operate a gravel/limestone quarry.  Said CUP was tabled at the April 24, 2001, BOCC meeting with the stipulation that a road maintenance agreement be established between the Construction Company & Butler County.  An agreement was accepted & approved by the BOCC at the June 5, 2001 meeting.

Commissioner Carpenter moved to accept the Conditional Use Permit (CU-01-02, Resolution 01-13), to establish a quarry by J&S Leasing, Inc./Bob Bergkamp Construction Company.

Commissioner Doll seconded the motion.  Motion carried 3-0

 

WALNUT RIVER BRIDGE REHABILITATION ON SW 100TH

Darryl Lutz, County Engineer, presented & reviewed cost proposals and statements of qualifications from engineering firms solicited for providing professional services related to study, design and plan preparation for the proposed rehabilitation of the Walnut River Bridge east of Augusta, on SW 100th St. (Old 54 Hwy).  Three consulting firms (experts in this area, familiar with this bridge & known by Mr. Lutz) were sent RFP’s with a response due date of Friday, 6/8/01.  Commissioner Shriver felt Mr. Lutz should study the proposals received and return to the board with recommendations.

Commissioner Doll moved to accept the proposals from the engineering firms for the purposes of the study of design work of Walnut River Bridge, and have the County Engineer bring back recommendations.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

ROAD RIGHT-OF-WAY DEDICATION

Darryl Lutz, County Engineer, reviewed a document pertaining to the right-of-way dedication from Mr. Jim O’Donnell, made in accordance with the County Zoning & Subdivision requirement for the correct description of said right-of-way. The dedication is the result of a rezoning case approved by the BOCC & a lot split approved by the Planning Commission prior to the moratorium.

Commissioner Carpenter moved to accept the road right-of-way agreement by Jim O’Donnell (legally described as The West 50 feet of the South 405 feet of the N/2 SW/4 of Section 15, Township 27 South, Range 5 East of the 6th P.M., in Butler County, Kansas), and authorize the Chair to sign the right-of-way document.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

UTILITY AGREEMENTS FOR SW 70TH ST. PROJECT

Darryl Lutz, County Engineer, presented & reviewed agreements, which are standard form agreements approved by KDOT. The County is required to enter into utility agreements with any affected companies for projects using federal aid funds.  This project pertains to SW 70th St., between Santa Fe Lake Road & Ohio St. Rd.

Kaneb Pipeline Company

Kaneb Pipeline has 2 road crossings that will need to be lowered & cement encased.

Commissioner Doll moved to approve the utility agreement with Kaneb Pipeline Company, related to for the SW 70th St. project between Santa Fe Lake Rd & Ohio St. Rd., to lower the pipeline, and allow the board to sign.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

Western Resources, Inc.

Western Resources, Inc. has a cross-country electric transmission line that will need to be raised to accommodate construction of SW 70th St.

Commissioner Doll moved to approve the utility agreement with Western Resources, Inc. and Butler County for adjustment of electric lines, related to for the SW 70th St. project between Santa Fe Lake Rd & Ohio St. Rd., and allow the board to sign.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

DOUGLASS SCHOOL DISTRICT SCHOOL RESOURCE OFFICER

Jim Keller, Superintendent of Douglass School District; Sgt. Kelly Alexander, BUSO Training & Grant Division; & Stan Cox, Butler County Sheriff; presented & reviewed information regarding an application for “COPS In School” Grant to provide a School Resource Office (SRO) for the Douglass School District.  Sgt. Alexander noted that, if approved, this grant would provide 100% of the salary & benefits for a SRO for 3 years, after which these costs would be born by the School District.  Douglass School District has agreed to cover the purchase cost of a vehicle to start the SRO; however Butler County will furnish uniforms & a vehicle in the future.

Commissioner Carpenter moved to approve the grant application to allow a School Resource Officer in Douglass, and authorize the County Administrator to sign.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

SUPPORT SERVICES AGREEMENT FOR REVERSE 911

Chris Davis, Director of Emergency Communications, presented & reviewed a Support Services Agreement, indicating that said agreement is not optional but covers necessary updates of phone numbers to the database.  In addition, Mr. Davis noted that The Commission signed the Software License Agreement on 4/1/01, and the cost of the 1st 2 years of maintenance is covered by a $30,000 donation by Frontier Refinery.

Commissioner Doll moved to approve the Support Services Agreement for Reverse 911 Agreement, which is covered in a $30,000 grant acquired by Frontier Refinery for a period of 2 years, and authorize the Chair to sign.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.
