BUTLER COUNTY BOARD OF COMMISSIONERS
Tuesday, March 27, 2001
The
Butler County Board of Commissioners was called to order by Commission
Chairman, Bill Shriver. Present were
Commissioners Randy Doll and Will Carpenter along with County Administrator,
Jay Newton and Clerk’s Secretary, Tindel Jennison.
APPROVAL OF ADS & ABATES
Commissioner
Doll moved to approve Ads totaling$193.24 and Abates totaling $99.15 per
approval #2044. Commissioner Carpenter
seconded the motion that carried 3-0.
CHECK PRESENTATION TO BU. CO. GIS/MAPPING
The
Butler County GIS/Mapping Department received a $10,000 check in support of
work from the Kansas Department of Commerce and Health ($5,000) and the
Whitewater River Watershed District ($5,000).
BUTLER COUNTY JAIL BIDS
Dan
Ferguson presented JE Dunn’s bid / budget summary along with a copy of the Bid
Tabulation for the twenty-nine (29) packages received on March 22, 2001 for the
Butler County Jail Project. Bids were
opened on March 22, 2001 for all projects except the bid from Diaz Masonry for
Bid Package 4000. The County Commission
authorized the Masonry Package to be re-bid.
The
following eight bids were rejected so that they could be re-bid within the next

In
addition to re-bidding the above referenced Bid Packages, JE Dunn will be
reviewing potential Value Engineering considerations associated with the
following Bid Packages: 2000 - Site & Building Excavation, 2500- Site
Utilities, 3400 – Precast Concrete & 4000 – Masonry.
JE
Dunn will continue to work closely with Treanor Architects to ensure this
project meets the established budget.
JE Dunn) believes that the majority of the cost overruns within the
above referenced Bid Packages are a result of bidding anomalies and
non-competitive bids. It is believed
that further clarification of the documents and additional local bidders may be
obtained to ensure competitive pricing.
The remaining twenty-one (21) Bid Packages may be held (bid remain
effective) for the next 60 days prior to expiration. Pending re-bid and evaluation of potential Value Engineering
considerations, JE Dunn will schedule a meeting with the Butler County
Commission to discuss project costs.

Carpenter moved to authorize JE Dunn and Treanor Architects to hold bids with
the exception of eight (8) packages outlined in the bid presentation (see
above), re-bid and do value engineering.

PLANNING MATTERS

Doll moved to approve Resolution 01-09
(RZ-01-06) rezoning land located at the southeast corner of Highway 196 and
Butler Road from Agricultural to Commercial.

Doll moved to accept the bids presented and authorize the County Engineer to
bring back his recommendation to the Board.

ECON. DEVEL. MONTHLY REPORT
Larry
Powell reviewed two items from the monthly Butler County Economic Development
meeting::
1.
Andover Rail Line -
This rail line is needed before the Andover Sherwin Williams plant can be
expanded per plant manager, Bill Ellison.
2.
Brownfield Project -
Williams Pipeline Assessment expected by the end of 2001 with problems
identified and their solutions stated along with a cost estimate. Plan will be submitted to Williams Energy
for review and a decision will be made regarding the next step.
Commissioner
Shriver will attend the next Augusta City Council meeting, April 16 with Larry
Powell to speak with them regarding the Brownfield project.

CENTRAL AVE. PAVING BIDS – Shay to Park
Bids
received for Central Avenue Paving from Shay Street to the Park entrance

Doll moved to accept the low bid from APAC for paving of Central Avenue from
Shay Street to the park entrance for USD 385, Andover, including the change
order for the total amount of $655,133.28.
Commissioner Carpenter seconded the motion that carried 3-0.
USD 385 INFRASTRUCTURE IMPROVEMENTS
Commissioner
Carpenter moved to approve the amendment to the January 6, 1999 Engineering
Agreement with Poe & Associates of Kansas, Inc. (to provide Landscape
Architecture services for tree planting along the Shay Avenue and Central
Avenue right-of-way) from $68,300 to $73,200 and authorize the Chair to
sign. Commissioner Doll seconded the
motion that carried 3-0.
NEW ROSE HILL SAFETY FACILITY
Dan
Armstrong, FD #3 Fire Chief, visited with the Board regarding a new FD #3 fire
station at Rose Hill. 1.1 acres of land
were purchased for this purpose two years ago.
Mr. Armstrong stated that the population of Rose Hill has increased rapidly
and that rather than just a fire station, it is prudent to consider a safety
facility similar in scope to the Augusta Public Safety Facility. This would require more acreage than the
site purchased. Mr. Armstrong felt that
the 1.3 acres would sell at a profit and that a larger tract of land was
available .
Dan
Woydziak, Rose Hill City Mayor, Roy Raine, Rose Hill City Police Chief and, all
present, shared their agreement with the plan.
Mr. Woydziak stated that this would facilitate city office growth and
remodeling plans.
Financing
could be handled through the Public Building Commission’s bonding capacity with
lease back to users to support the cost of debt service.
Mr.
Armstrong will proceed with land, negotiations and purchase of a new land
site. Commissioner Doll moved to
authorize the County Administrator to work with Richard Kraybill, (Architect
for the Augusta Public Safety Facility), and bring back a Professional Services
Contract for the proposed Rose Hill Safety Facility. Commissioner Carpenter seconded the motion that carried 3-0.
