BUTLER COUNTY BOARD OF COMMISSIONERS

Monday, March 12, 2001

 

The Butler County Board of Commissioners was called to order by Commission Chair, Bill Shriver.  Present were Commissioners Randy Doll and Will Carpenter along with County Administrator, Jay Newton and Clerk’s Secretary, Tindel Jennison.

 

APPROVAL OF VOUCHERS

Commissioner Doll moved to approve County Vouchers totaling $410,324.74 dated March 12, 2001.  Commissioner Carpenter seconded the motion that carried 3-0.

 

MENTAL RETARDATION MONTH

Commissioner Shriver moved to approve the proclamation of the month of March 2001 as Mental Retardation Awareness Month and urge all citizens of Butler County to give full support of efforts towards enabling people with mental retardation to live full and productive lives of inclusion in our community.  Commissioner Doll seconded the motion that carried 3-0.

 

NEW JUDICIAL BLDG – PROP ACQUISTION

Commissioner Doll moved to authorize the County Administrator to work with the County Counselor towards acquisition of property at 200 W. Ash, Lots 3, 4, and 5, Block 6 Original Town Addition, City of El Dorado a.k.a. the Barnhill property and allow the existing tenant to remain in the building at her discretion.  If purchase by negotiation is not possible, the County Counselor was directed to proceed with acquisition by eminent domain provided Mrs. Elsie Barnhill could continue to remain in the apartment she now occupies.  Commissioner Shriver seconded the motion that carried 2-1.  Commissioner Carpenter voted against.  

 

EXECUTIVE SESSION

Commissioner Shriver moved to go into Executive Session to discuss the acquisition of property for 10 minutes.  Commissioner Carpenter seconded the motion that carried 3-0.

 

REGULAR SESSION

Commissioner Shriver brought the meeting back into Regular Session at 9:35 AM.

 

COUNCIL ON AGING APPT

Commissioner Shriver moved to appoint Shirley Gray to the Council On Aging Board to another unexpired term ending December 31, 2002 (District #2, Rosalia).  Commissioner Carpenter seconded the motion that carried 3-0.

 

NOXIOUS WEED HOUSE BILL 2468

Riley Walters informed the Board regarding House Bill 2468 and cost sharing on Noxious Weed Chemicals.  If this bill passes in the present form it would make cost sharing optional rather than the present requirement for counties to cost share.  This could affect the amount of weed control in neighboring counties that would in turn adversely affect weed infestation in Butler County.  Presently the state legislature determines cost sharing policy.  This bill would make it the Secretary of State’s responsibility.

Commissioner Shriver moved to approve a letter to the state legislators involved in the agricultural committee requesting opposition to House Bill 2468.  Commissioner Doll seconded the motion that carried 3-0. 

 

PRAIRIE ROSE CHUCK WAGON DINNER - CONDITIONAL USE

(CU-99-10 & Bu Co Res 99-39)

Bruce and Michele Labes, neighbors of the Prairie Rose Chuck Wagon Dinner property, visited with the Board regarding possible Conditional Use permit violations. 

Butler County Planning and Zoning Director, Todd Kennemer, will visit with Thomas Etheredge, owner of the Prairie Rose Chuck Wagon Dinner and review the Conditional Use and Planning minutes on file.

The Commission requested that a freeze be placed on any new construction until further evaluation of the conditional use permit.

 

BLDG DEMOLITION BIDS

Jerry Penwell visited with the Board regarding the demolition bids on the Gordy Street building and the Wiebe Tire building (new Judicial Building).  Mr. Penwell was concerned regarding a competitor’s bid (Banks Construction).  One of the two buildings was approximately twice the size as the other and the bid of Bank’s Construction was less on the larger building than the other building.  He was also concerned that the bids were not opened per usual protocol (bids received by a time deadline and all opened at a Commission meeting at the announced  time.

 

Commissioner Carpenter left the meeting at 10:10 AM for the Quad County Planning Forum.

 

FD #7 FIRE BD APPT

Commissioner Doll moved to appoint Ryan McCune to the Fire District #7 Fire Board.  Commissioner Shriver seconded the motion that carried 2-0.

 

DEMOLITION BIDS – JUDICIAL BLDG PROJECT

Commissioner Shriver moved to reject the Building Demolition bids for the Gordy Street building and the Wiebe Tire building and to receive new bids from present bidders as well as other bidders.  Bids will be for each building separate and also buildings tied together with the Board having the option to accept either separate or total low bid.  Bid opening will be held at 9:15 AM on Tuesday, March 27, 2001.  Commissioner Doll seconded the motion that carried 2-0.

Commissioner Shriver moved to adjourn.  Commissioner Doll seconded the motion that carried 2-0.
