BUTLER COUNTY BOARD OF COMMISSIONERS

Commission Chairman, Bill Shriver, called the Butler County Board of Commissioners to order.  Present was Commissioners Randy Doll & Will Carpenter; County Administrator, Jay Newton; and Commission Secretary, Marcy Zwall.

 

JUDICIAL BUILDING – FINAL PLANS

Dan Ferguson, Construction Manager, & Dan Rowe, Architect, presented final plans to the Board for review.  He indicated that he should only take about 8 more days to complete the necessary documents.  Mr. Ferguson noted that they are trying to encourage local bids.

Commissioner Doll moved to accept the final plans for the County Courts Building & establish a date of September 11, 2001, at 2:00p.m., to be the time to receive bids.

Commissioner Carpenter seconded the motion. Motion carried 3-0.

 

PURCHASE CARD PROGRAM

Ron Roberts, County Clerk, and Jill Hughey, on behalf of the Accounting Department, presented & reviewed a Travel & Entertainment Credit Card Program. Mr. Roberts advised that this program is currently in use by the Cities of Wichita & El Dorado, as well as Sedgwick County.  He explained that these cards are similar to credit cards.  However the County controls the total dollar limit, total daily dollar limit, & total dollar limit per purchase.   Moreover, the County can also control the type of merchants where the cards can be used, as well as the types of merchandise that can be charged.  Mr. Roberts also commented that the only cost involved would be for labor to set up the program, and employee training.  The Commissioners recommended trying one or two departments at a time.

Commissioner Carpenter moved to recommend the implementation of a Purchase Card Program, & allow Ron Roberts to proceed with its implementation, on a phased-in basis.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

SW 70TH ROAD CONSTRUCTION PROJECT: 

Darryl Lutz, County Engineer was present to review the following items:

 

Farney Flood Protection Berm:

Mr. Lutz requested authorization of a Notice of Contractors calling for bids to construct the aforementioned berm.

Commissioner Doll moved to authorize a Notice to Contractors for bids to construct the Farney Flood Protection Berm as a part of the SW 70th St. construction project; and allow the Board to sign.  The bid date will be Augusta 28, 2001, at 10:00a.m., in the office of the County Clerk at the courthouse.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

Commissioner Shriver moved to take a 10-minute recess at 10:01a.m.

 

 

RECONVENE

The regular session reconvened at 10:11a.m.

 

Right-Of-Way Purchase:

Commissioner Doll moved to accept the easement right-of-way purchase from Barbara Murfin Murphy for the SW 70th St. project, in the amount of $6,175.00; and allow the Chairman to sign.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

Commissioner Carpenter moved to accept the easement right-of-way purchase from Stephen Craig Carr & Deborah Carr, in the amount of $850; and allow the Chairman to sign.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

Commissioner Doll moved to accept the right-of-way purchases for the SW 70th St. project from Eva Jeanette Carr as follows:

- A 1.86-acre tract of land in the NE/4 NE/4 S10-T27S-R4E, in the amount of $4,650;

- A 0.16-acre tract of land in the NW/4 NE/4 S10-T27S-R4E, in the amount of  $400;

- A 2.43-acre tract of land in the NW/4 S10-T27S-R4E, in the amount of $6,075;

- A 0.50-acre tract of land in the NE/4 NE/4 S10-T27S-R4E, in the amount of $1,025;

- A 0.17-acre tract of land in the NW/4 S10-T27S-R4E, in the amount of $425;

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

Commissioner Carpenter moved to accept the right-of-way easement purchase from

Robert D. Chorn, & wife Betty, in the amounts of $250 for a 0.1-acre tract in the SE/4 S3-T27S-R4E; and $8,625 for a 3.45-acre tract in the SE/4 of S3-T27S-R4E; and allow the Chair to sign.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

Commissioner Carpenter moved to approve the easement right-of-way from

Virginia Lassman in the amount of $12,000, for a 4.80-acre tract of land in the SE/4 SW/4 S5-T27S-R4E; 

& Fred T. Lassmann & Kathy J. Lassmann, in the amount of $7,500, for a 3.0-acre tract of land in the SW/4 SW/4 S5-T27S-R4E; and allow the Chair to sign.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

ROAD PROJECT’S 5-YEAR PLAN

Darryl Lutz, County Engineer, presented & reviewed a report on Butler County’s road project approved in the KDOT 5-year plan.

Commissioner Carpenter moved to accept the report from Darryl Lutz, County Engineer, regarding KDOT’s 5-Year Plan.

Commissioner Doll seconded the motion.  Motion seconded 3-0.

 

 

LANDFILL COMPACTOR REPLACEMENT

Darryl Lutz, County Engineer requested authorization for the Department of Public Works to solicit sealed bids for a landfill compactor.  Commissioner Doll inquired as to the benefits of leasing.  Mr. Lutz informed the Board that this type of equipment gets worn out too fast to lease.  Further, he approximates about 125 hours of use a month, and an initial cost of about $125,000.  The primary use of this machine will be to compact the trash.  It is also capable of spreading it.

Commissioner Carpenter moved to authorize the Director of Public Works to solicit sealed bids for a landfill compactor.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

COMPETITIVE IMPLEMENTATION GRANT

Darryl Lutz, County Engineer, announced the grant award of $45,000 from KDHE.  He requested permission to obtain a proposal for professional services related to the design of a compost site to handle wood waste & grass clippings, due to the Commissioners ban on greenwaste in the landfill.  In addition, Mr. Lutz asked for authorization to proceed with requests for bids for the front-end loader approved in the grant.  He feels the equipment would cost around $65,000, which would allow them to meet their 25% match.

Commissioner Doll moved to authorize solicitation of bids for a front-end loader to implement the Greenwaste Program, with the $45,000 grant received from KDHE.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

CONSULTING AGREEMENT

Kyle McMallow, Department of County Appraiser, presented & reviewed a consulting agreement with McCully & Associates for the 2002 valuation year.  She informed the Board that the Appraisal Department’s goal is to do this in-house.  Further, she noted that there is a capable employee on staff now, but she would need training.  Commissioner Carpenter suggested negotiating the price.  Mrs. McMallow indicated that this was the only consulting firm that she was aware of in the state of Kansas, and they had been providing this service at the same cost for the past several years.

Commissioner Carpenter moved to accept the agreement with McCully & Associates for consulting services in determining annual commercial index/depreciation rate studies, development of income & expense models, capitalization rate studies, effective tax rate study & rental rate/expense studies, in the amount of $5,000, for the 2002 valuation year.

Commissioner Doll seconded the motion.  Motion carried 3-0.

 

NEXTEL CELLULAR CONTRACT

Chris Davis, Emergency Communications Director; Grant Helferich, EMS Director; Jim Schmidt, Emergency Management Director; and Stan Cox, Butler County Sheriff, presented & reviewed a contract between Nextel & Butler County for cell phones.  Mr. Davis reminded the Board that this program had a vast coverage area.  In addition, all present confirmed other benefits such as the departments’ ability to make one “all-call”, with privacy; the departments would be able to pool their minutes; 2-way talk does not

get charged for minutes, which is the majority of their communication.  Commissioner Carpenter suggested negotiation the cost of this contract as well.  Mr. Helferich informed the Board that he understood that the first month would be free if they signed up now.

The Commissioners announced that they were in favor of the concept; however, they wanted to find out how many phones might be needed through out the County’s departments and invite the Nextel representative to negotiate this with the Board.

Commissioner Doll moved to table this item until future data is received.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

DIETICIAN CONTRACTUAL SERVICES

Mr. Newton, on behalf of Carol Borger, Health Department Director, requested a contractual agreement providing for dietician services for the Butler County Health Department rather than having an employee fill that position.  Mr. Newton noted that with benefits, this employee would receive about $23,400/year, to work part-time.  

Commissioner Shriver moved to deny the signing of the contract for dietician services.

Commissioner Carpenter seconded the motion.  Motion carried 3-0.

 

WALNUT TOWNSHIP APPOINTMENT

Commissioner Shriver moved to appoint Len Casey (12747 SW US Hwy 77, Augusta, KS 67010, 775-1817), be appointed as clerk of Walnut Township.

Commissioner Doll seconded the motion.  Motion carried 3-0.
