BUTLER COUNTY BOARD OF COMMISSIONERS

Monday, October 15, 2001

 

Commission Chairman, Bill Shriver, called the Butler County Board of Commissioners to order. Present were Commissioners Randy Doll & Will Carpenter; County Administrator, Jay Newton; and Commission Secretary, Marcy Zwall.

 

APPROVAL OF MINUTES

Commissioner Doll moved to approve the Butler County Commission Meeting minutes of Monday, October 8, 2001, and Tuesday, October 9, 2001.  Commissioner Carpenter seconded the motion. Motion carried 3-0.

 

APPROVAL OF VOUCHERS

Commissioner Doll moved to approve vouchers totaling $152,174.82, dated October 15, 2001.  Commissioner Carpenter seconded the motion. Motion carried 3-0.

 

PRELIMINARY ZONING REGULATIONS COMPREHENSIVE PLAN

Todd Kennemer, Director of Planning & Zoning, gave a preliminary presentation of an update to the Comprehensive Plan & amendments to Zoning & Subdivision Regulations.  This was a request from the Commissioners after issuing a moratorium on June 26, 2001.  Mr. Kennemer stressed that this plan is not designed to replace the current one but upgrade it.  He stated that he took the approach of the “Supply side” vs. the “Demand side”, making better use of what we have.  In his presentation, Mr. Kennemer highlighted the following issues and gave suggestions for “tweaking” different areas within them: 

1)                  Growth Areas:  “Cores” (the cities), “Gradient Areas” (Cities’ Comprehensive Plan areas), “Periphery Areas” (outside the Gradient areas but within the statutorily set 3-mile growth ring), “Rural Area” (outside the Periphery areas but within the proposed Urban Growth Area), and “Preservation Area” (outside the Urban Growth Area).

2)                  Land Use:  Rural Residential requirements, Platting Fees, “Conservation Overlay”, and Island Annexations.

3)                  Transportation:  Develop a balance of Speed vs. Access.

4)                  Public Services:  (outside of Urban Growth Area) water, sewage, gas, telecommunications.

5)                  Environment Protection:  Flood zones & open space requirement

6)                  Zoning Codes & Subdivision Regulations:  PRD-B, Monitoring land locked lots, researching benefits of 80-acre minimum lot sizes in the “Preservation Area”.

The Board was very impressed with the proposed plan and the time & effort gone in to create it.  They all agreed that it should be submitted to the Planning Committee for discussion & suggestions.  In addition, after that Committee receives recommendations, the Commissioners felt it necessary to present it to the “affected groups”, such as Realtors; then hold a public hearing.

 

OTHER ITEMS

·                     4th Annual Butler County Employee Craft Fair:  In the past the 4-H building fee has been waived.  Commissioner Carpenter moved to waive the fee for the 4-H Building for the Butler County Craft Fair.  Commissioner Doll seconded the motion.  Motion carried 3-0.

·                     SW 70th St. Right-of-way acquisition:  Darryl Lutz reported that he is proceeding with condemnation on two properties.  One hearing was held last week.  The County Counselor was able to expedite the procedure on the other to allow the timeline to be met.  The hearing should be either this Friday or the next.  Further, Mr. Lutz indicated that there is still an opportunity to negotiate with the owner, prior to the hearing, which is his preference.  Mr. Lutz reminded the Board that the project goes to letting on Wednesday.

·                     The Commissioners felt that it was necessary to set a deadline to discuss an investment policy as well as an Investment Committee with the new Treasurer.  November 5th was the date scheduled.

Commissioner Carpenter moved, having no further business before the board, to adjourn the meeting. Commissioner Doll seconded the motion.  Motion carried 3-0.
