BUTLER COUNTY BOARD OF COMMISSIONERS

CALL TO ORDER 

Commission Chairman Dan Woydziak called the Butler County Board of Commissioners to order at 9:00 a.m.  Present were Commissioner Will Carpenter, Commissioner Randy Doll, Commissioner Randy Waldorf, Commissioner Mike Wheeler, Administrator Will Johnson, Jr., and Clerk Ron Roberts.

 

APPROVAL OF MINUTES

Commissioner Waldorf motioned to approve the minutes of the Butler County Commission Meeting of Tuesday, October 3, 2006 as written.  Commissioner Doll seconded the motion.  Motion carried 5-0.        

 

ITEM #1 – CONSIDER APPROVAL TO PURCHASE THE UTILITY VEHICLE USER RELATIONS AGREEMENT WITH KAWASAKI AND 321 KAWASAKI FOR THE USE OF A MULE UTILITY FOR BUTLER COUNTY EMERGENCY SERVICES

Grant Helferich, Director of EMS, came before the board for approval of a Utility Vehicle User Agreement with Kawasaki.

 

This Utility Vehicle can be used by all emergency services in Butler County. The users will need to take a vehicle safety operations course before they can use this vehicle as part of the agreement with the User Relations Agreement. Butler County will also need to show of liability insurance on the vehicle. This agreement is renewable every 90 days and Kawasaki will provide the county with a new Mule Utility Vehicle.

 

The County is responsible for routine servicing every 90 days or 25 hours whichever comes first at a cost of $125.00.

 

Norm Manley, Butler County Counsel, has reviewed and approved this agreement.

 

Commissioner Waldorf motioned to approve the Mule Utility Vehicle User Relations Loan Agreement with KAWASAKI   and 3..2..1.. KAWASAKI and allow the Chair to sign.  Commissioner Wheeler seconded the motion.  Motion carried 5-0.

 

ITEM #2 – CONSIDER APPROVAL TO ADOPT AMENDMENTS TO THE BUTLER COUNTY ECONOMIC DEVELOPMENT BY-LAWS

David Alfaro, Director of Economic Development, came before the Board for approval to adopt Amendments to the BCED By-Laws as presented.

 

The Board of Directors of BCED are no longer involved with the budget process. They have no daily oversight of the operations and have agreed to meet bi-monthly versus monthly.

 

Commissioner Doll motioned to approve the Amendments to the BCED By-Laws as presented.  Commissioner Waldorf seconded the motion.  Motion carried 5-0.

 

ITEM #3 – CONSIDER APPROVING THE AWARD OF PURCHASE OF PIPE CULVERTS FOR THE HIGHWAY DEPARTMENT

Darrel Lutz, P.E., Director of Public Works, Director of Public Works, came before the Board for approval of the purchase of pipe culverts for the Highway Department. The Board opened and read the bids on Tuesday, October 3, 2006. The low bid is $17,687.00, from J & J Metal Products, Paola, KS.

 

Pipe culvert purchases are budgeted each year in the Road & Bridge fund.

 

Commissioner Woydziak motioned to approve the purchase of pipe culverts for the Highway Department, with J&J Metal Products, Paola, KS.  Commissioner Carpenter seconded the motion.  Motion carried 5-0.  

 

ITEM #4 – CONSIDER AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO SUBMIT A GRANT APPLICATION TO THE KDHE FOR FUNDING A PORTION OF THE RECYCLING PLANNING WORK

Darrel Lutz, P.E., Director of Public Works, came before the Board for authorization to submit a grant application to the KDHE in behalf of Butler County for funding a portion of the recycling planning work. The application deadline is Friday, October 13, 2006. If the Grant is approved, Butler County’s out-of-pocket cost will be reduced from $50,000 to $12,500.

 

Commissioner Waldorf motioned to authorize Darrel Lutz, P.E., Director of Public Works to submit a grant application to the KDHE in behalf of Butler County for funding a portion of the recycling planning work.  Commissioner Doll seconded the motion.  Motion carried 5-0.

 

ITEM #5 – CONSIDER APPROVAL OF THE CONTRACT WITH MCCOLLUM CONSTRUCTION FOR THE REHABILITATION OF THE HISTORIC COURTHOUSE

Will Johnson, Butler County Administrator, came before the Board for approval of a contract with McCollum Construction for the rehabilitation of the Historic Courthouse. Including the bid price of $575,483.00, the County will spend approximately $639,000.00 on the rehabilitation project. $215,000.00 of the money will come from grants and tax credits. The remaining $444.000.00 will come from monies left over from the PBC arbitrage ($210.000) and from the Capital Reserve $224,000.00.

 

Commissioner Doll motioned to approve the contract with McCollum Construction not to exceed $575,483.00 for the purpose of refurbishing the exterior of the Butler County Courthouse and allow the Chair to sign.  Commissioner Carpenter seconded the motion.  Motion carried 5-0.

 

APPROVAL OF VOUCHERS

Commissioner Carpenter motioned to approve the vouchers dated October 10, 2006 in the amount of $475,571.50.  Commissioner Waldorf seconded the motion.  Motion carried 5-0.

 

APPROVAL OF ADDS AND ABATES

Commissioner Doll motioned to approve Adds & Abates #2278 dated October 10, 2006.  Adds in the amount of $672.08 and Abates in the amount of $633.34.  Commissioner Waldorf seconded the motion.  Motion carried 5-0.

Commissioner Woydziak recessed the Board meeting at 9:43am for 5 minutes.

OTHER ITEMS OF BUSINESS TO COME BEFORE THE BOARD OF COUNTY COMMISSIONERS:

Financial Officer Mark Detter came before the board to review the financial status of the various county funds.  The report was very favorable.  Expenditures are at or below budgeted amounts, and in most funds, revenues are above estimated amounts.

Commissioner Waldorf motioned to adjourn the meeting of the Board at 10:27 a.m.  Commissioner Doll seconded the motion.  Motion carried 5-0.
