Commission Chairman Dan Woydziak called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Will Carpenter, Commissioner Randy Doll, Commissioner Randy Waldorf, Commissioner Mike Wheeler, Administrator Will Johnson, Jr., and County Clerk Ron Roberts.
ITEM #1 – CONSIDER APPROVING THE PURCHASE OF AN ADDITIONAL LICENSE FOR
DRAFTING AND ENGINEERING SOFTWARE FOR THE PUBLIC WORKS DEPARTMENT
Darryl Lutz, P.E., Director of Public Works, came before the Board for
approval of the purchase of an additional license for drafting and engineering
software. The Public Works Department
presently owns two licenses and uses Auto Cad virtually every day for design
work and creating plan sheets. In order
to accommodate drafting and design work by our new engineer, the Department
needs to purchase an additional license for the Auto Cad software. Cost to
purchase one additional license is $8,506.80 plus approximately $1,000 annual
support.
Commissioner
Doll motioned to approve the purchase of one license of Autodesk (Auto Cad)
civil engineering and drafting software for the Public Works Department on GSA
pricing in the total amount of $8,506.80.
Commissioner Wheeler seconded the motion. Motion carried 5-0.
ITEM
# 2 – CONSIDER APPROVING THE PURCHASE OF RIGHT-OF-WAY FOR A BRIDGE REPLACEMENT
PROJECT AT WILDCAT CREEK ON NW COUNTY LINE ROAD
Darryl Lutz, P.E., Director of Public Works, came before the Board for
approval of the purchase of right-of-way for a bridge replacement project at
Wildcat Creek on NW County Line Rd.
This acquisition is for two tracts totaling 0.34 acres, and the
Department of Public Works has offered $850 for this property. The Bridge Building Fund will be funding
this acquisition.
Commissioner
Carpenter motioned to approve the purchase of a total of 0.34 acres of
right-of-way in two tracts from Deer Run, L.L.C. (c/o Patricia Scott) for
Project No. 841-C-4443 (B-352), the Sedgwick County project across the Wildcat
Creek on NW County Line Rd. at a cost of $850 and authorize the Chair to sign
said right-of-way documents.
Commissioner Doll seconded the
motion. Motion carried 5-0.
ITEM
# 3 – CONSIDER APPROVING AN AGREEMENT FOR SIGNALIZING THE BNSF RAILROAD CROSSING
AT SW BOYER ROAD LOCATED NORTHWEST OF EL DORADO
Darryl Lutz, P.E., Director of Public Works, came before the Board for
approval of an agreement for signalizing the BNSF railroad crossing at SW Boyer
Rd. located northwest of El Dorado. KDOT has approved project funding for the crossing and has
prepared agreements for the work.
Commissioner
Carpenter motioned to approve the agreement between Butler County, KDOT and
BNSF for installing automatic gates and signals at the crossing of the BNSF and
SW Boyer Rd. known as Project No. 8 X-2545-01 and authorize the Chair to
sign. Commissioner Wheeler seconded the
motion. Motion carried 5-0.
ITEM #4 – UPDATE ON 2006 BUTLER COUNTY ANNUAL TOWNSHIP MEETING
Butler County will be holding the 2006 Annual County Engineer’s Meeting with Township Officials on Monday, March 6, 2006. The meeting will be held in the Butler County Community Building (4-H Building) from 8:30 a.m. to 3:00 p.m.

Commissioner Doll motioned to
approve Adds & Abates #2246 dated January 31, 2006. Abates in the amount of $27,773.76 and Adds
in the amount of $3,282.64.
Commissioner Carpenter seconded the motion. Motion carried 5-0.

ITEMS OF BUSINESS
Administrator Johnson presented a draft of Resolution 06-11 for the Commissioners review.
A resolution outlining procedures for enacting an open burning ban in Butler County.
Commissioner Woydziak recessed the Board meeting at 10:10 a.m. for 10 minutes.
Commissioner Woydziak reconvened the Board meeting at 10:20
a.m.
Administrator Johnson presented a revised version of Resolution 06-11 containing changes requested by the Board.
Commissioner Waldorf motioned
to approve Resolution 06-11 detailing procedures to ban open burning in Butler
County. Commissioner Wheeler seconded the motion. Motion carried 5-0.
Administrator Johnson presented a Resolution 06-12 for the Commissioners review.
A resolution enacting an open burning ban in Butler County until such time as conditions warrant lifting the ban.
Commissioner Wheeler motioned to approve Resolution 06-12 enacting an open burning ban in Butler County until such time as conditions warrant lifting the ban. Commissioner Waldorf seconded the motion. Motion carried 5-0.
Commissioner Waldorf motioned to adjourn the meeting
at 11:05 a.m. Commissioner Carpenter seconded the motion. Motion carried 5-0.
