Commission Chairman Dan Woydziak called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Will Carpenter, Commissioner Randy Doll, Commissioner Randy Waldorf, Commissioner Mike Wheeler, Administrator Will Johnson, Jr., and Clerk Recorder Tammy Bridges.
The Agenda was amended to hear Item 5 and 6 first.
ITEM
#5 – CONSIDER ENGINEERING PROPOSALS FOR 2006 SEMI-ANNUAL GROUNDWATER
MONITORING WORK AND GENERAL ENGINEERING SERVICES AT THE BUTLER COUNTY LANDFILL
Darryl Lutz, P.E., Director of Public Works, came before the Board for
approval of engineering proposals for 2006 semi-annual groundwater monitoring
work and general engineering services at the landfill. Municipal solid waste landfills are required
under state and federal regulations to sample, test, and analyze groundwater
twice each year. Groundwater monitoring
work and general engineering support is budgeted for each year in the landfill
budget in the amount of $45,000 and $15,000 respectively.
Commissioner
Doll motioned to approve engineering services provided by Burns & McDonnell
Engineering Company under Authorization No. 30 in the amount of $32,450 for
2006 semi-annual groundwater monitoring work at the landfill and under
Authorization No. 31 in the amount of $15,000 for 2006 general engineering
support for the landfill and authorize the Chair to sign both. Commissioner Waldorf seconded the motion. Motion carried 5-0.
ITEM
#6 – CONSIDER APPROVING AN AGREEMENT FOR SIGNALIZING THE BNSF RAILROAD CROSSING
AT NE 110TH STREET LOCATED SOUTHWEST OF CASSODAY
Darryl Lutz, P.E., Director of Public Works, came before the Board for
approval of an agreement for signalizing the BNSF railroad crossing at NE 110th
Street located southwest of Cassoday.
KDOT advised Butler County Public Works staff several months ago that
two BNSF railroad crossings in Butler County were being considered for
signalization. KDOT will pay 100% of
the cost of this work using federal funds.
County Counsel Norm Manley has reviewed and approved the agreement.
Commissioner
Wheeler motioned to approve the agreement between Butler County, KDOT, and BNSF
for installing automatic gates and signals at the crossing of the BNSF and NE
110th St. known as Project No. 8 X-2544-01 and authorize the Chair
to sign. Commissioner Carpenter
seconded the motion. Motion carried
5-0.
ITEM #1 – CONSIDER A REQUEST BY DAVID WHEAT FOR A CONDITIONAL USE PERMIT TO
EXPAND EXISTING COMMERCIAL USES ON PROPERTY CONTAINING 2 ACRES LOCATED IN THE
AG-40 ZONING DISTRICT (CASE NO. CU-06-03) {RESOLUTION NO. 06-21}
Rod Compton, Director of Planning and Zoning, came before the Board for
approval of a request by David Wheat.
Mr. Wheat has applied for a Conditional Use Permit to expand existing
commercial uses on property located in the Ag-40 zoning district. The applicant is wishing to establish an
office and vehicle impound yard for his wrecker service, which has been located
in Augusta. He would like to be able to
display vehicles for sale in the space in front of the building currently
housing the detail shop. Staff
recommended approval to the Planning Commission and the Planning Commission
also recommended approval.
Mrs. Fitzgerald came before the Board and said the driveway is within 40 feet of her home, and it is a 24-hour business with tow trucks coming in at all hours of the night. She said they hear the trucks beeping and coming and going. Mrs. Fitzgerald said this would affect their lives 24 hours a day.
Mr. Wheat said the only time there would be trucks coming in at odd hours is if there is a wreck or impound for the Sheriff. He stated that painted corrugated steel has been purchased to screen the area where the impounded cars will be stored.
Commissioner Carpenter motioned
to approve the request by David Wheat for a Conditional Use Permit and
authorize the Chair to sign Resolution No. 06-21. This permit will also be subject to installing a solid privacy
fence surrounding the impound storage area.
Commissioner Waldorf seconded the motion. Motion carried 5-0.
ITEM
# 2 – CONSIDER AN APPLICATION FOR A HOMESTEAD LOT SPLIT WITH APO FOR SHEILA
HARDMAN AND ROSE MARY TEMPLIN (CASE NO. PL-05-16)
Rod Compton, Director of Planning and Zoning, came before the Board for
approval of a request by Sheila Hardman and Rose Mary Templin for a Homestead
Lot Split & Agricultural Preservation Overlay (APO). The property is located approximately ¼ mile
north of Rosewood (SW 170th St.) on the west side of Butler (Rose
Hill) Rd. The applicants are making
this request in order to legitimize a split of a 5 acre parcel off of a 40 acre
parcel. The Planning Commission, by a 5
to 1 vote, recommended denial of the request.
Commissioner
Carpenter motioned to deny Case No. PL-05-16, the APO Lot Split located in the
Northeast Quarter of the Southeast Quarter of Section 30, Township 28 South,
Range 3 East of the 6th P.M., Butler County, Kansas. Commissioner Wheeler seconded the
motion. Motion carried 5-0.
ITEM
#3 – CONSIDER A REQUEST BY DONALD DRAPER FOR REZONE OF APPROXIMATELY 10 ACRES
FROM AN AG-40 TO RR RURAL RESIDENTIAL (CASE NO. RZ-06-03) {RESOLUTION NO.
06-20}
Rod Compton, Director of Planning and Zoning, came before the Board for
approval of a request by Donald Draper to rezone property from Ag-40 to Rural
Residential. The property contains
approximately 160 acres in Towanda Township.
The applicant is proposing to rezone approximately 10 acres from an
Ag-40 to RR in order to divide it into two parcels, each of which would contain
a residence. The request is being made
in order to allow the sale of the residences with 5 acres each instead of 40
acres. The Butler County Planning
Commission recommended approval of this rezoning by a 5 to 1 favorable vote.
Commissioner
Carpenter motioned to deny Resolution No. 06-20. Commissioner Doll seconded the motion. Motion carried 5-0.

ITEM
#4 – CONSIDER APPROVAL OF A REQUEST FROM COMPUTER SERVICES TO SOLICIT REQUEST
FOR PROPOSALS (RFP) FOR A STORAGE AREA NETWORK (SAN) AND BLADE SERVER SOLUTION
Scott Stoskopf, Computer Services Director, came before the Board for
permission to send out RFP for a Storage Area Network (SAN) and Blade Server
Solution. Butler County’s main storage
server was purchased in 2001 with 400GGB of usable storage. The utilization of the file storage server
is expected to exceed current capacity by June. The Blade Server solution will allow the development of a Server
Farm. This will provide opportunity for
redundant application servers, while saving money on future growth. Estimated 2006 expenditures will be
$115,000. Computer Services has
budgeted $58,000, Deeds Technology Fund $39,000, and the remaining $18,000 will
come from Public Works and Motor Vehicle.
Commissioner
Waldorf motioned to approve Computer Services to proceed with the RFP process
for a Storage Area Network and Blade Server Solution. Commissioner Carpenter seconded the motion. Motion carried 5-0.

OF ADDS AND ABATES
Commissioner Carpenter motioned
to approve Adds & Abates #2254 dated April 4, 2006. Adds in the amount of $3,582.18 and Abates
in the amount of $5,229.94. Commissioner
Waldorf seconded the motion. Motion
carried 5-0.

ITEMS OF BUSINESS
Administrator Johnson said the jail count was 216 with 144 billable.
Commissioner Woydziak said that he and Commissioner Waldorf attended an Emergency Medical Services meeting. As a result of the meeting, a committee was formed to review protocol. Commissioner Woydziak said our goal is to provide the best quality of services for the citizens of Butler County.
Commissioner Woydziak stated that he filed for office today.
