Commission Meeting on the Road

Commission Chairman Dan Woydziak called the Butler County Board of Commissioners to order at 6:00 p.m. Present were Commissioner Will Carpenter, Commissioner Randy Doll, Commissioner Randy Waldorf, Commissioner Mike Wheeler, Administrator Will Johnson, Jr., and Clerk Ron Roberts.

#3 – ITEMS OF MUTUAL CONCERN BETWEEN THE CITY OF AUGUSTA AND BUTLER COUNTY
Augusta City Administrator welcomed the Commissioners to Augusta and
thanked them for bringing their meeting to Augusta.
The Administrator asked if there could be some joint effort with the
County to help Augusta with their recycling programs.
He also expressed concern about the number of bicycle riders on SW 70th
Street between Augusta and Andover. He
felt the hills, curves, lack of paved shoulders, and speed of traffic on the
road made it dangerous for the bicyclists and wanted to know if the County
could restrict bicycle traffic on that stretch of road.
Commissioner Woydziak said he agreed and felt it was dangerous to ride
bicycles on that road and a few other county roads, but by State law bicyclists
have the right to ride on the roads and the County cannot prohibit them.
Administrator Keefer said they were having some problems getting their
Special Assessments attached to the correct parcels and are working with their
Bond council and the County Clerk’s office to get those straightened out.
Lastly, he said the city was trying to keep the railroad right of way
mowed, but there are still some areas that have debris left behind. He stated it would be helpful to them if the
County could finish cleaning up the right of way.
ITEM #4 – CONSIDER
APPROVING THE PURCHASE OF HIGHWAY TRAFFIC PAINT FOR THE COUNTY HIGHWAY DIVISION
Darryl Lutz Director of Public Works returned to the Board with his recommendation for purchase of traffic paint and glass beads for 2006. After Tabulating bids received and opened on April 24 for traffic paint and glass beads, Director Lutz recommended approving the purchase of yellow traffic paint from San Gar Ltd., Salina Kansas for the total purchase price of $23,823.80, the purchase of white traffic paint from Sherwin Williams, El Dorado, Kansas for a total purchase price of $35,412.30, and the purchase of reflective glass beads from Flex-O-Lite, Fenton, Missouri for a total purchase price of $12,100.
Commissioner Carpenter pointed out that there was only $835 difference in buying all of the paint from Sherwin Williams and splitting the colors between San Gar and Sherwin Williams. Commissioner felt that it was worth the difference to purchase all of the paint from one vendor and to support an in county vendor.

Carpenter motioned to approve the purchase of 2,695 gallons of yellow and 4,015
gallons of white traffic paint from Sherwin Williams, El Dorado, Kansas for
$60,071.55. Commissioner Wheeler
seconded the motion. Motion carried
5-0.
Commissioner
Carpenter motioned to approve the purchase of 44,000 pounds of reflective glass
beads from Flex-o-Lite, Fenton, Mo. for $12,100.00. Commissioner Waldorf seconded the motion. Motion carried 5-0.
ITEM #5 – CONSIDER PROPOSALS FOR JANITORIAL CONTRACT
Ken Bratton, Director of Buildings and Grounds, came before the Board for
approval of the best bid submitted for janitorial services for county
facilities.
Commissioner
Waldorf motioned to recommend acceptance of the Bid from Triple R in a sum not
to exceed $6,611.66 per month and authorize staff to finalize execution of the
documents for IFB BG003. Commissioner
Carpenter seconded the motion. Motion
carried
5-0.
ITEM
#6 – CONSIDER RESOLUTION NO. 06-27 APPOINTING THE COUNTY APPRAISER FOR BUTLER
COUNTY
Will Johnson, Administrator, came before the Board for approval to
appoint Elysa K. Lovelady as Butler County Appraiser.
Commissioner
Woydziak motioned to appoint Elysa K. Lovelady as Butler County Appraiser. Commissioner Waldorf seconded the
motion. Motion carried 5-0.
ITEM
#7 – CONSIDER A REQUEST FROM THE CITY OF ANDOVER FOR APPROVAL OF ANNEXATION AND
SETTING OF A PUBLIC HEARING IN ACCORDANCE TO K.S.A. 12-521
Will Johnson, Administrator, came before the Board to receive the request
for annexation from the City of Andover and establish a public hearing date for
Tuesday, June 6, 2006 at 9:00 a.m. in accordance to K.S.A. 12-521. The request for annexation was received on
March 30, 2006 and the statute states that a public hearing be established not
less than 60 days nor more than 70 days from presentation of the request to the
County Commission.
Commissioner
Doll motioned to set the date for a public hearing of an annexation request by
the City of Andover in accordance to K.S.A. 12-521 as June 6, 2006 at 9:00 a.m.
and waiving the notification requirements as the property to be annexed is
dedicated rights of way under the ownership of Butler County. Commissioner Carpenter seconded the motion. Motion carried 5-0.
ITEM #8 – CONSIDER A REQUEST FROM
THE CITY OF TOWANDA FOR APPROVAL OF ANNEXATION AND SETTING OF A PUBLIC HEARING

Will Johnson, Administrator, came before the Board to receive the request
for annexation from the City of Towanda and establish a public hearing date for
Tuesday, June 6, 2006 at 9:00 a.m. in accordance to K.S.A. 12-521. The request for annexation was received on
April 7, 2006 and the statute states that a public hearing be established not less
than 60 days nor more than 70 days from presentation of the request to the
County Commission.
Commissioner
Carpenter motioned to set the date for a public hearing of an annexation
request by the City of Towanda in accordance to K.S.A. 12-521 as June 6, 2006
at 9:00 a.m. and waive the notification requirements, as the property to be
annexed is dedicated rights of way under the ownership of Butler County. Commissioner Wheeler seconded the motion. Motion carried 5-0.
APPROVAL
OF ADDS AND ABATES
Commissioner Waldorf motioned
to approve Adds & Abates #2257 dated April 25, 2006. Adds in the amount of $2,774.04 and Abates
in the amount of $1,044.86.
Commissioner Doll seconded the motion.
Motion carried 5-0.
OTHER
ITEMS OF BUSINESS
Administrator Johnson informed the
commissioners that the invoice to Harry Helgerson Company that they had
questioned was for Grave Markers. The
County is required to furnish markers for veterans’ graves in cemeteries within
the county.
Commissioner Waldorf motioned to adjourn the meeting
