BUTLER COUNTY BOARD OF COMMISSIONERS

Commission Chairman Mike Wheeler called the Butler County Board of Commissioners to order at 9:00 a.m.  Present were Commissioner Will Carpenter, Commissioner Randy Doll, Commissioner Randy Waldorf, Commissioner Dan Woydziak, Administrator Will Johnson, Jr., and Clerk Ron Roberts. 

 

ITEM #1 – CONSIDER APPROVAL OF AN APPLICATION BY SCOTT GILL TO REZONE 80 ACRES FROM AG-80 TO AG-40 (CASE NO. RZ-05-13) {RESOLUTION NO. 05-52}

Rod Compton, Director of Planning & Development, came before the Board for approval of an application by Scott Gill to rezone 80 acres from Ag-80 to Ag-40.  This property is located on the southwest corner of the intersection of SE 40th Street and Cole Creek Road.  Mr. Gill is requesting the rezoning in order to sell 40 acres as a residential site.  The Butler County Planning Commission by a 4 to 2 vote recommended denial because of its location outside the Urban Growth Boundary in a sparsely settled rural area.  Also, they felt a change to the Ag-80 and/or the Urban Growth Boundary should occur as part of an overall study after careful consideration and not on a piece meal approach.  Mr. Compton stated that he feels the Planning Commission’s action represents some inconsistencies.  There have been previous rezoning requests for the same type of change in which it has recommended approval even though the parcel was several miles from the border of the Ag-80 zoning district and the Ag-40 classification would represent an island in a sea of Ag-80.

 

Commissioner Woydziak motioned to approve the application by Scott Gill to rezone the North Half of the Northeast Quarter of Section 28, Township 26 South, Range 6 East from Ag-80 Agricultural to Ag-40 Agricultural and authorize the Chair to sign Resolution No. 05-52 approving the rezoning.  Commissioner Waldorf seconded the motion.  Motion failed 3-2. Commissioners Carpenter and Doll voted no.  A super majority vote or a 4 to1 vote is required to over turn a Planning Board recommendation.

 

Commissioner Carpenter motioned to return the case to the Planning Commission to have it reconsider its action in light of the fact that all shareholders of the property had been contacted and had signed the application subsequent to the Planning Commission meeting, also to reconsider the location to growth areas and clarification of growth boundaries.

Motion seconded by Commissioner Woydziak.  Motion carried 4-1.  Commissioner Doll voted no.

 

ITEM #2 – CONSIDER APPROVAL OF AN APPLICATION BY RONNIE BANNON TO REZONE APPROXIMATELY 30 ACRES FROM AG-40 TO RR RURAL RESIDENTIAL (CASE NO. RZ-05-12) {RESOLUTION NO. 05-53}

Rod Compton, Director of Planning & Development, came before the Board for approval of an application by Ronnie Bannon to rezone approximately 30 acres from Ag-40 to RR Rural Residential.  This property is located ¼ mile west of U.S. Highway 77 on the south side of SW 163rd Street on the east edge of the unincorporated community of Gordon.  The property is bounded on the north, south, east, and west by the Ag-40 zoning district, and the County’s Urban Growth Boundary runs right through the community of Gordon.  Mr. Bannon is requesting the rezoning in order to sell an existing residential site containing 5 acres and to create another parcel of 25 acres that would be eligible for a building permit for a single-family dwelling.  The

Butler County Planning Commission by a 6 to 0 vote recommended approval of the rezoning because it was felt the rezoning would be in conformance with the comprehensive plan.

 

Commissioner Woydziak motioned to approve the application by Ronnie Bannon to rezone the Southwest Quarter of the Northwest Quarter of Section 27, Township 28 South, Range 4 East from Ag-40 Agricultural to RR Rural Residential and authorize the Chair to sign Resolution No. 05-53 approving the rezoning.  Commissioner Carpenter seconded the motion.  Motion carried 5-0.

Commissioner Wheeler recessed the Board at 9:55 a.m. for 5 minutes.

 

RECONVENE

Commissioner Wheeler reconvened the Board meeting at 10:05 a.m.

 

APPROVAL OF ADDS & ABATES

None.

 

RECESS TO EXECUTIVE SESSION

Commissioner Doll motioned to recess into executive session at 10:00 a.m. to discuss matters dealing with non-elected personnel for 30 minutes.  Commissioner Carpenter seconded the motion. Motion carried 5-0.  Session included the 5 Commissioners, Will Johnson and Gus Collins.

 

RECONVENE

Chairman Wheeler called the meeting back to order, from executive session, at 10:50 a.m.

 

OTHER ITEMS OF BUSINESS TO COME BEFORE THE BOARD OF COUNTY COMMISSIONERS

Commissioners discussed updating the Compressive Plan and doing an updated citizen survey.

 

Administrator Johnson showed the commissioners the final draft of the Butler County fact sheet.

 

ADJOURNMENT

Commissioner Woydziak motioned to adjourn the meeting of the Board at 11:10 a.m.  Commissioner Doll seconded the motion.  Motion carried 5-0.
