COUNTY BOARD OF COMMISSIONERS

CALL TO ORDER
Commission Chairman Mike Wheeler called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Randy Doll, Commissioner Randy Waldorf, Commissioner Dan Woydziak, Administrator Will Johnson Jr., and Clerk Recorder Tammy Bridges. Commissioner Will Carpenter arrived at 9:05 a.m.
ITEM #1 – CONSIDER UPDATES TO THE BUTLER COUNTY PLUMBING CODES, LP GAS CODES, MECHANICAL BUILDING CODES, AND RESIDENTIAL DWELLING CODES
Rod Compton, Director of Planning & Development, came before the
Board for an update on County Building Codes, including Plumbing Codes, LP Gas
Codes, Mechanical Codes, Building Codes, and Residential Dwelling Codes. The National code organizations update their
codes on a periodic basis, and many of the contractors in the County have
expressed concern that our codes are outdated.
In order to standardize the codes used by Butler County and the cities
in the County, it is being proposed to update the codes in the following
manner:
1.
Adoption of the 2003 Uniform Plumbing Code to replace the 1997
International Plumbing code.
2.
Adoption of the 2004 NFPA (National Fire Prevention Association) L.P. Gas
Code.
3.
Adoption of the 2000 Uniform Mechanical Code to replace the 1998
International Mechanical Code.
4.
Adoption of the 2003 International Building Code to replace the 1997
Uniform Building Code.
5.
Adoption of the 2003 International Residential Code to replace the 1995
CABO One and Two Family Dwelling Code.
This matter is scheduled
for a public hearing on Tuesday, May 31, 2005.
No action was taken at this time.
Rod Compton, Director of Planning & Development, came before the
Board regarding West Star Energy building a sub station at Frontier Refinery
and whether they need a building permit.
Mr. Compton presented letters from Todd Kennemer and Mike Bertrand
stating that the refinery did not need building permits. Administrator Will Johnson’s recommendation
is to send a letter stating that a building permit inspection of typical
maintenance on the facilities is not required.
However, for any process upgrades, a building permit will be required,
and for any occupied facilities a building permit fee and inspection will be
required. It was the consensus of the Board
to proceed with sending this letter to Frontier Refinery.
Commissioner Woydziak stated that a letter would be sent to the property
owner in Smileyberg telling them they had to remove the mobile home from the
property.
ITEM #2 – CONSIDER APPOINTING
VIEWERS AND SETTING A DATE AND TIME TO VIEW A PROPOSED ROAD VACATION ON SW
BOYER RD BETWEEN SW 220TH STREET AND SW 230TH STREET IN
ROCK CREEK TOWNSHIP
Will Johnson, Administrator, came before the Board to receive a petition, consider appointing viewers, and set a viewing date for vacating a portion of SW Boyer Road in Rock Creek Township. Catherine Pottorff, a resident property owner of Rock Creek Township, has submitted a petition requesting the vacating of one mile of SW Boyer Road between SW 220th St. and SW 230th Street. Part of the road has never been built and none of the road is being maintained by the Township. The county commission will need to appoint 3 road viewers and set a date that is approximately 20 days past the date of first legal publication. It is proposed to set a viewing date of Monday, June 20, 2005. The viewers will meet at the site to view the road and to receive comments for or against closing said road. A report will be prepared and made to the Board of County Commissioners either in favor of or against the petitioned request, which would likely be presented on the following day, Tuesday, June 21, 2005.
Commissioner Woydziak motioned to receive the petition to vacate SW Boyer Road between SW 220th Street and SW 230th Street in Rock Creek Township, to appoint myself (Commissioner Woydziak), Commissioner Waldorf and Commissioner Doll as road viewers and to set a date of Monday, June 20, 2005 at 8:00 a.m. to view said road. Commissioner Doll seconded the motion. Motion carried 5-0.
ITEM #3 – WORK
SESSION – INITIAL OVERVIEW OF ROAD SYSTEM AND BRIDGE SYSTEM AS PART OF A
COMPREHENSIVE UPDATE OF THE ROAD AND BRIDGE CIP
Administrator Johnson suggested tabling this agenda item until a later date.
APPROVAL OF MINUTES
Commissioner Waldorf motioned to approve the minutes of the Butler County Commission Meetings of Monday, May 9, 2005 and Tuesday, May 10, 2005 as written. Commissioner Woydziak seconded the motion. Motion carried 5-0.
APPROVAL OF VOUCHERS
Commissioner Carpenter motioned to approve the vouchers for May 16, 2005 in the amount of $174,852.71. Commissioner Woydziak seconded the motion. Motion carried 5-0.
OTHER ITEMS OF BUSINESS
The Board discussed the planning and zoning comprehensive plan.
The Board also discussed the Elk River Wind Farm.
Commissioner Woydziak stated that he attended the Commission Conference in Topeka last week and that it went well and he met a lot of people.
Commissioner Wheeler stated that he would be attending a meeting with Leadership Butler regarding Meth Labs and the Threat to Butler County on Thursday, June 2, 2005.
Administrator Johnson stated that Norm Manley has filed an injunction against Betty Squires on behalf of Butler County since she has started littering her property again.
Administrator Johnson stated that the Noxious Weed Department has sent out notices to three residents in Augusta.
Administrator Johnson showed the artist’s rendering of the remodeling project of the East Annex to the Courthouse.
Administrator Johnson came before the Board to receive bids for janitorial services. Bids were received from:
Central Plains Maintenance $1,507/Month
RRR Janitorial & Maintenance $1,904/Month
Mid America $1,700/Month
Commissioner Woydziak motioned to receive the bids and allow the Buildings and Grounds Director to review the bids and return with a recommendation at a later date. Commissioner Waldorf seconded the motion. Motion carried 5-0.
Administrator Johnson stated that relative to the Wind Farm project, there is a bridge on a township road that does not meet load requirements. Darryl Lutz has worked out an agreement with Elk River, who will forward a check to pay for engineering services to shore up the bridge and bring it up to weight limits required.

Commissioner Woydziak motioned to adjourn the meeting of the Board at 10:30 a.m. Commissioner Doll seconded the motion. Motion carried 5-0.
