BUTLER COUNTY BOARD OF COMMISSIONERS

Commission Chairman Mike Wheeler called the Butler County Board of Commissioners to order at 9:00 a.m.  Present were Commissioner Will Carpenter, Commissioner Randy Waldorf, Commissioner Dan Woydziak, Administrator Will Johnson Jr., and Clerk Recorder Tammy Bridges.  Commissioner Randy Doll was absent.

 

ITEM #1 – RECEIVE MR. AL REISS WITH REISS & GOODNESS ENGINEERS TO HEAR A PRELIMINARY REQUEST TO CREATE A PUBLIC SEWER DISTRICT TO SERVE THE CEDARS AND WAGON WHEEL RANCH AREAS NORTH OF SANTA FE LAKE      

Mr. Al Reiss, Reiss & Goodness Engineers, came before the Board for approval to create a public sewer district to serve the Cedars and Wagon Wheel Ranch areas north of Santa Fe Lake.  The cost of the district would be financed by a Community Development Block Grant (CDBG) and a Rural Development grant and loan.  The purpose today is for the Board to consider this request and weigh the merit of creating this sewer district.

 

Administrator Johnson suggested the Board take this request under advisement for informational purposes.  Mr. Johnson stated that the Board would have a number of work sessions to discuss this issue.

 

ITEM #2 – CONSIDER APPLICATION BY DAN BELTZ/B&E INVESTMENTS FOR REZONE FROM AG-40 TO RR (CASE NO. RZ-05-04) {RESOLUTION NO. 05-37}

Rod Compton, Director of Planning & Development, came before the Board with a request from Dan Beltz/B&E Investments to rezone property from AG-40 to RR.  This 60-acre parcel is located at the Southwest corner of SW 170th St. (Rosewood) and Prairie Creek Road.  The property is within ฝ mile of the City of Rose Hill and the purpose is to create two rural residential tracts.  One of the proposed tracts already contained a residence, while a new residence was proposed to be built on the other one.

 

On June 28, 2005, the Board voted 3-2 to send the Dan Beltz/B&E Investments request for rezoning back to the Planning Commission for reconsideration.  This matter was again presented to the Butler County Planning Commission on July 5, 2005.  The original recommendation of approval was reconfirmed.

 

There was much discussion regarding this issue.  Those who addressed the Board were Dan Beltz, property owner, Jim Hargrove, Attorney, and Joel Pile, City of Rose Hill.  It was discussed with the Beltz’s the future cost of the city expanding services beyond his property and the potential for high special assessments for the two lots, should they decide to serve areas beyond his current property.

 

Commissioner Carpenter motioned to approve the application by Dan Beltz to rezone a 60-acre parcel in the East Half of the Northeast Quarter of Section 32, Township 28 South, Range 3 East from AG-40 to RR Rural Residential and authorize the Chair to sign Resolution No. 05-37 approving the rezoning.  Commissioner Wheeler seconded the motion.  Motion carried 3-1. Commissioner Woydziak voted no.

ITEM #3 – CONSIDER APPROVAL OF 2005 CEREAL MALT BEVERAGE LICENSE FOR R & L SALES

Will Johnson, Administrator, came before the Board for approval of a 2005 Cereal Malt Beverage License for R & L Sales.  Ida L. Watts filed on June 22, 2005 to receive a license to sell cereal malt beverages in original and unopened containers not for consumption on premises.

 

Commissioner Woydziak motioned to approve the 2005 Cereal Malt Beverage License for

R & L Sales. Commissioner Waldorf seconded the motion.  Motion carried 4-0.

 

ITEM #4 – RECEIVE AND OPEN BIDS FOR BUTLER COUNTY STREET MAPS

Pamela Dunham, Butler County GIS, came before the Board to receive bids for the County map project.  Street maps were last produced for Butler County in 1993 as a joint effort with Economic Development, Planning and Zoning, and Emergency Management.  These maps were two-sided 2’ x 3’ glossy providing a rural street map on the front and city street maps on the back.  The special feature about these maps was the grid identifying where each street was located within the county or city.  As this was a 2004-budgeted project, availability of funds and feasibility of the project for 2005 will need to be determined.  Bids were received from Color Impressions, Inc., and Rand Graphics.  The Board did not read the amounts.

 

Commissioner Woydziak motioned to receive the bids for new Butler County Maps, turn them over to the GIS Director for tabulation, and return to the Board with a recommendation.  Commissioner Waldorf seconded the motion.  Motion carried 4-0.

 

ITEM #5 – CONSIDER ACCEPTING A DEDICATION OF PUBLIC ROAD RIGHT-OF-WAY AT THE INTERSECTION OF 13TH STREET AND 159TH STREET WEST OF ANDOVER FOR A SEDGWICK COUNTY ROAD PROJECT

Darryl Lutz, P.E., Director of Public Works, came before the Board for approval to accept a dedication of public road right-of-way (ROW) related to the Sedgwick County 13th Street project near Andover.  Sedgwick County has plans to reconstruct 13th Street from K-96 to the Butler County Line near Andover.  Part of the project includes constructing a new intersection at 159th Street (County Line).  The project requires additional ROW within the unincorporated area of Butler County.  The ROW tract for consideration is on the Southeast Corner of the intersection of 13th and 159th Street.  This tract of ROW is to be purchased by Sedgwick County.  However, the ROW is geographically located in Butler County.  Consequently, the Board of County Commissioners of Butler County is required to accept the ROW.  The area of ROW being acquired is standard for intersections in metropolitan areas.  County Counsel, Norm Manley, has approved this Easement for Right-of-Way.

 

Commissioner Carpenter motioned to accept the right-of-way dedication of 0.608 acres of land from William A. and Mary Lou Hadwiger at the southeast corner of the intersection of 13th Street and 159th Street related to the Sedgwick County 13th Street project, said tract to be paid for by Sedgwick County, and authorize the Chair to sign.  Commissioner Woydziak seconded the motion.  Motion carried 4-0.

 

ITEM #6 – WORK SESSION – 2006 BUTLER COUNTY BUDGET

Will Johnson, Administrator, came before the Board to discuss the 2006 Butler County Budget.

 

Commissioner Woydziak motioned to approve the Notice of Hearing on the Amended 2005 Budget for the 16th day of August at 9:00 a.m. at the Butler County Courthouse for the purpose of hearing and answering objections from taxpayers related to the proposed amended use of funds.  Commissioner Waldorf seconded the motion.  Motion carried 4-0.

 

Commissioner Waldorf motioned to approve the Publication of the 2006 Butler County Budget.  Commissioner Woydziak seconded the motion.  Motion carried 4-0.

 

APPROVAL OF ADDS & ABATES

Commissioner Woydziak motioned to approve Adds & Abates #2229.  Abates in the amount of $1,337.12 and Adds in the amount of $0.00.  Commissioner Carpenter seconded the motion.  Motion carried 4-0.

 

OTHER ITEMS OF BUSINESS TO COME BEFORE THE BOARD OF COUNTY COMMISSIONERS

Commissioner Carpenter stated that Will Johnson would be bidding on an animal at the 4-H Auction tomorrow on behalf of the Board of County Commissioners.

 

Administrator Johnson presented an update on new locations for the County Prescription Drug Card.

 

Administrator Johnson stated that Ken Bratton, Director of Buildings and Grounds, has been working on the custodial contract to maintain all the buildings including the East Annex.  The Board requested a cost comparison.
