COUNTY BOARD OF COMMISSIONERS

Commission Chairman Mike Wheeler called the Butler County Board of Commissioners to order at 9:00 a.m. Present were Commissioner Will Carpenter, Commissioner Randy Doll, Commissioner Randy Waldorf, Administrator Will Johnson Jr., and Clerk Recorder Tammy Bridges. Commissioner Dan Woydziak was absent.
ITEM #1 RECEIVE
MARION NICHOLS WITH MIDCAP TO DISCUSS APPROVAL OF 2005 KANSAS EMERGENCY SHELTER
GRANT
Marion Nichols, Community
Service Director with Mid-Cap, came before the Board for approval of the 2005
Kansas Emergency Shelter Grant in the amount of $15,000. Mid-Kansas Community Action Program provides
services and counseling to low income populations with the intent to help
people reach self-sufficiency. The
agency collaborates with other service agencies and individuals to meet
individual and community needs.
Programs include Emergency Services, Case Management, Tenant Based
Rental Assistance, Head Start, Summer Food Program, Child and Adult Food
Program, Parenting Coalition and Community Based Housing Opportunities.
Commissioner Carpenter
motioned to approve the application for the 2005 Kansas Emergency Shelter Grant
and allow the Chair to sign.
Commissioner Doll seconded the motion. Motion carried 4-0.
ITEM #2
CONSIDER A REQUEST FOR A ZONING CHANGE FROM AG-40 TO COMMERCIAL FOR APPLICANT
DAVID WELCH (CASE NO. RZ-02-13) {RESOLUTION NO. 05-17}
Rod Compton, Director of
Planning & Development, came before the Board for approval of adopting
Resolution 05-17, amending Resolution 02-75; a resolution approving a zoning
change from an AG-40 zoning classification to a commercial zoning
classification for property owned by David Welch. On December 10, 2002, the Board approved Resolution 02-75 thereby
approving a rezoning application by David Welch to rezone approximately 4.1
acres located approximately 1/8 of a mile west of Meadowlark Road on the south
side of U. S. Highway 54.
The property was rezoned
from AG-40 classification to a Commercial classification because Mr. Welch was
proposing to develop the property for a new shop for his Heating and Air
Conditioning business; however, he did not immediately do so.
He has recently
approached the Planning & Zoning Department with a building permit
application for this development. In
the course of reviewing the application, it was discovered that the resolution
approving the rezoning (Resolution 02-75) contained the wrong legal
description. The description given in
the published resolution would place the property immediately to the east of
what was actually rezoned. The legal
description given for the Notice of Public Hearing publication was correct, it
was simply turned around in the resolution.
The Notice of Hearing was properly published and the surrounding
property owners were notified as to the rezoning for the proper parcel. Staff feels that this should be corrected so
there is no mix-up in the future regarding the zoning of the affected property. A new resolution has been prepared to correct
the error made in Resolution 02-75.
County Counsel Norm Manley has approved the language of the resolution.
Commissioner Doll
motioned to approve Resolution 05-17 amending the legal description as
originally published in Resolution 02-75 allowing zoning classification change
on certain property in Butler County and allow the Chair to sign. Commissioner Carpenter seconded the
motion. Motion carried 4-0.

MARCH FINANCIALS
Administrator Will Johnson presented the Board with a review of the March Financial Report.

REVIEW OF PERSONNEL POLICIES
Administrator Will Johnson presented the Board with a review of personnel policies.

ITEM #5 WORK SESSION SALES TAX
Administrator Johnson initiated discussion regarding the sales tax issue for Butler County.
Commissioner Carpenter motioned to approve Adds & Abates #2218. Adds in the amount of $4,637.02 and Abates in the amount of $64,995.28. Commissioner Doll seconded the motion. Motion carried 4-0.
OTHER ITEMS OF BUSINESS
Commissioner Carpenter reminded the Board about the Farm Bureau meeting tonight.
Commissioner Doll stated that he spoke to the students of Sunrise Academy in Bel Aire regarding county government in Kansas. He stated that the kids were very sharp and asked good questions related to the mill levy, sales tax, wind farms, and hog farms.
Administrator Johnson stated that the jail count is 198 with 136 billable.

Johnson stated that the cost of cleaning up Betty Squires property was $11,045.71.
